The provision of Self-contained Breathing Apparatus, associated equipment and services, including but not limited to:
- purchase or lease of self-contained breathing apparatus, with or without maintenance services,
- purchase or lease of compressed cylinders or re-valving of existing cylinders, with or without maintenance services,
- purchase or lease of related telemetry, with or without maintenance services,
- maintenance services for existing breathing apparatus and/or cylinders,
- purchase of replacement parts for breathing apparatus.
The equipment provided must:
a) supply the wearer with respirable air independent of the external environment;
b) be capable of operating in all fire and rescue environments when used by operational fire-fighters.
It is essential that the equipment provided must be compliant with the UK legislation in force at the time that the equipment enters operational service.
It shall be possible to upgrade the Self-contained Breathing Apparatus and associated equipment during the life of the contract, subject to new wearer requirements and technological innovations. These upgrades will be subject to assessment before acceptance.

Devon and Somerset Fire and Rescue Authority is acting as lead Authority (the Authority) for the provision of Self-contained Breathing Apparatus, associated equipment and services to the Fire and Rescue Authorities in England, as defined by the Fire and Rescue Services Act 2004 and to other bodies associated with Fire and Rescue activities with similar requirements, including: the Ministry of Defence Fire Service; Department of Communities and Local Government; Fire and Rescue Authorities in Scotland, Wales, Northern Ireland, the States of Jersey and Guernsey, Isle of Man, the Fire Service College, Ambulance Services in the UK, Airport Fire Services in the UK, Metropolitan Police and the British Transport Police.
The actual quantities are not known but it is envisaged that over the 4 year period of the framework agreement in the region of 2 000 sets of self-contained breathing apparatus and associated equipment and services will be procured under the framework by Fire and Rescue Services in England.

III.1.3)Legal form to be taken by the group of economic operators to whom the contract is to be awarded:
Expressions of interest may be submitted by a single organisation or a consortium.
Organisations bidding as either a consortium or subcontracting arrangement will be regarded as partners and will be jointly and severally liable under the Contract terms.
A grouping or consortium will be required to indicate in its response expression of interest whether the partnership will take the form of:
a) a new or existing legal entity which will sign the Contract with the Authority in case of award; or
b) a group of partners not constituting a new legal entity, who via a power of attorney, signed by an authorised representative of each partner (except the lead partner), designate one of the partners as lead partner, and mandate him as lead contractor to sign the Contract with the Authority in case of award.
The composition and constitution of the grouping or consortium, and the allocation of the scope of tasks amongst the members shall not be altered without the prior written consent of the Authority which consent may be withheld at their discretion. The Authority reserves the right to disqualify any consortium which changes its composition after pre-qualification without the prior consent of the Authority.

(a) is bankrupt or is being wound up, where his affairs are being administered by the court, where he has entered into an arrangement with creditors, where he has suspended business activities or is in any analogous situation arising from a similar procedure under national laws and regulations;
(b) is the subject of proceedings for a declaration of bankruptcy, for an order compulsory winding up the administration by the court or of an arrangement with creditors or of any other similar proceedings under national laws and regulations;
(c) has been convicted by a judgment which has the force of res judicata in accordance with the legal provisions of the country of any offence concerning his professional conduct;
(d) has been guilty of grave professional misconduct proven by any means which the contract authorities can demonstrate;

(h) has been the subject of a conviction for participation in a criminal organization, as defined in Article 2(1) of Council Joint Action 98/733/JHA;
(i) has been the subject of a conviction for corruption, as defined in Article 3 of the Council Act of 26.5.1972 and Article 3(1) of Council Joint Action 98/742/JHA3 respectively;
(j)has been the subject of a conviction for fraud within the meaning of Article 1 of the Convention relating to the protection of the financial interests of the European Communities;
(k) has been the subject of a conviction for money laundering, as defined in Article 1 of Council Directive 91/308/EEC of 10.6.1991 on prevention of the use of the financial system for the purpose of money laundering.
