Award of a contract without prior publication of a contract notice in the Official Journal of the European Union (in the cases listed in Section 2 of Annexes D1, D2 or D3 as appropriate) Justification for the choice of the negotiated procedure without prior publication of a contract notice in the OJEU in accordance with Directive 2004/18/EC The justification for the use of this procedure is to ensure continuity of care for seven young people that are currently placed within the block beds contract which is due to terminate in December 2017. The block contract provides two homes one based in Middlesbrough (4 bedded) and 1 in Hartlepool (3 bedded) and allows Middlesbrough to place vulnerable young people either directly within or 20 miles within its boundaries which enables contact with family, community and school. Middlesbrough Council currently has 3 in-house children's homes and in addition to the 7 block beds also commissions around a further 50 independent residential placements. Middlesbrough does not have a high number of residential providers within its boundaries and wishes to avoid these beds being filled by young people from out of areas as this in turn would result in more Middlesbrough young people being placed outside of the borough. There is also achievement of value for money which the block arrangement will achieve which over the contract period will be over 600 000 GBP. The current block contract arrangement was put in place 5 years ago when Part B services were exempt from the Public Contract Regulations, however, following the publication of the PCR 2015 Light Touch has been introduced and as such no further contract can be entered into as PCR would apply and therefore this VEAT notice is being published.
