    • absence of competition for technical reasons
Explanation:

Commercially Supported Shipping, part of the United Kingdom Ministry of Defence, intends to award a Contract to Kongsberg Maritime Ltd for the support to the Hydrographic Sonar System, which works alongside specialist software on board Royal Navy vessels. The contract will have a duration of three years (plus two option years).

It is considered that this contract can be placed using the negotiated procedure without prior publication of a contract notice pursuant to Article 32(2)(b)(ii) of Directive 2014/24/EU (Regulation 32(2)(b)(ii) of the Public Contract Regulations 2015) on the basis that competition is absent for technical reasons. The relevant support to the Kongsberg Multi-Beam Echo System can only be fully achieved and supported by Kongsberg Maritime Ltd. Kongsberg Maritime Ltd holds all the available technical information (drawings, interfaces, test and calibration specifications/procedures, jigs and tools etc.) necessary to undertake the full in-service support of their equipment to ensure that it operates in accordance with the original design intent such that it is safe to use in service by RN personnel.
