Explanation:

The Contracting Authority relies on the ground set out within Regulation 32(2)(b)(ii) (Use of the negotiated procedure without prior publication) of the Public Contracts Regulations 2015. For technical reasons, the services can only be provided by a particular tenderer. This is the incumbent supplier, Suez Recycling and Recovery UK Limited (company name changed from Sita UK Limited on 24.3.2016).

The Contracting Authority has received services from Suez over the past 4 years and requires Suez to continue to provide services for up to a further 12 months whilst a new procurement exercise is carried out. This will initially be for 6 months with the option to extend for up to a further 6 months.

The Contracting Authority anticipates selecting a procurement route and inviting tenders in the coming weeks. However, due to the need to receive continuity of service, the Contracting Authority seeks to receive a service for the intervening period based on the reasons set out below.

As 1 element of the current arrangement, the Contracting Authority relies upon Suez to carry out cannabis factory disposals, a highly specialist requirement with numerous safeguards required. The Contracting Authority relies upon Suez to be on call 24 hours a day, 7 days a week to collect and dispose of paraphernalia from these disposal sites. Suez has the expertise to spot waste which could be hazardous at disposal sites and has procedures in place to have this chemically tested and disposed of in an appropriate manner. Suez already has a pool of staff vetted to National Police Vetting Level 2 which is an essential requirement of the Contracting Authority in this service area. The vetting process is lengthy due to the sensitive nature of work carried out by the Contracting Authority and it would not be viable to enlist an alternative supplier on an interim basis. Suez understands the reactive and spontaneous nature of the services required by the Contracting Authority. The Contracting Authority also requires supplier consistency for its current programme of high level disposal activity and Suez is already embedded in this project.

The existing contract with Suez is due to expire on 31.3.2017 and it is essential that there is no break in the service as this would present an operational risk to the Contracting Authority. The Contracting Authority seeks to enter into a new contract with Suez initially for 6 months but for up to 12 months. Maximum estimated spend is 600 000 GBP.
