Explanation:

The contract award is lawful because the contract modifications are not substantial within the meaning of Regulation 72(8) Public Contract Regulations 2015. The modification to the contract does not materially change the services from the services described in the original contract, nor does it change the economic balance to favour the incumbent contractor. The change will postpone the date of the required benchmarking and market testing requirements by an additional 10 years. In return, the contracting authority will receive monies commensurate with the cost of completing such benchmarking and market testing exercise. There is no change to the contract specifications, and as such, no conditions are introduced that would have allowed the admission of other candidates or attracted additional participants to the original tender procedure, or resulted in the acceptance of another tender.
